The 2011 first-round pick started seven of 13 games, had 5 1/2 sacks and 35 tackles after a lackluster rookie year. Earlier this year, he pleaded guilty to DUI and reckless driving and was sentenced to a six-month suspended jail term, a year of probation and a $600 fine. He hopes a pretrial diversion program will allow those charges to be dismissed.
A Mobile municipal judge has dismissed a misdemeanor marijuana charge against Fairley.|||||||
Defense attorney Sid Harrell said the charge was dismissed on Tuesday. Judge Matt Greene agreed with prosecutors that there wasn't enough evidence to show partially smoked marijuana cigarettes found in Fairley's vehicle on April 3 belonged to the former first-round pick out of Auburn. Harrell says Fairley passed a drug test Tuesday, is tested several times a week by the NFL and has passed them all.

Fairley was arrested in Mobile County on May 27 after a state trooper said he was traveling at 100 mph in his Cadillac Escalade and initially didn't pull over. He also faces a misdemeanor marijuana possession charge Nov. 27 in his hometown of Mobile. Fairley was a 2011 first-round pick after helping lead Auburn to a BCS title.
