The Chicago Sun-Times is reporting that an Indiana University-Purdue University Indianapolis hotel worker has alleged in a lawsuit that Colts DT Eric Foster sexually assaulted her before the AFC championship game.

Foster, a valuable reserve on the Colts’ defensive line, is being accused of sexual assault, battery, false imprisonment and intentional infliction of emotional distress.

Marion County Prosecutor Carl Brizzi declined to press charges, the Sun-Times said.

Attorney April Board of Valparaiso said the IUPUI Police Department mishandled the case, forcing her client to file a lawsuit in Marion County Circuit Court.

The lawsuit claims the incident took place 8:20 a.m. CT, Jan. 24, the morning of the day the Colts hosted the Jets at Lucas Oil Stadium.

The Colts declined comment, and Foster's agent, Joby Branion, did not respond to an interview request.

The suit alleges Foster assaulted the woman, who was a receptionist at the hotel in which the Colts were staying, after she delivered a dental kit to Foster’s room on a floor reserved solely for Colts personnel.

On ESPN’s “Mike and Mike” show Tuesday morning, NFL commissioner Roger Goodell was asked about the suit and indicated that the league would react pending further information on the incident.
